Welcome to Kinetoflex. By accessing or using our website (https://www.kineto-flex.com/) and purchasing our digital training programs, custom programs, or 1:1 online coaching services (collectively, the "Services"), you agree to be bound by these Terms of Service. These Terms are an agreement between you and Kinetoflex LLC ("we," "our," or "us").

1. HEALTH AND MEDICAL DISCLAIMER

1.1. Not Medical Advice: The fitness, flexibility, and strength training programs provided by Kinetoflex LLC are for educational and informational purposes only. They are not a substitute for professional medical advice, diagnosis, or physical therapy. 1.2. Assumption of Risk: Dance and fitness training involve inherent risks of injury. By participating in our programs, you agree that you are doing so at your own risk. You should consult a physician or healthcare professional before starting any new fitness program. Kinetoflex LLC and its coaches are not liable for any injuries or damages sustained while undertaking these programs. 1.3. Liability Waiver: For 1:1 Online Coaching and Custom Programs, clients are required to sign a separate Liability Waiver before services commence. The terms of that specific waiver work in conjunction with these Terms of Service.

2. DIGITAL PRODUCTS & SERVICES

2.1. Digital Training Programs: Upon purchase of a self-guided training program or flexibility bundle, you will receive access to digital materials (PDFs, video links, etc.). 2.2. Custom Programs & 1:1 Coaching: Custom programs and live coaching are tailored to the individual. You agree to provide accurate information regarding your health, fitness level, and goals to ensure the safe creation of your program.

3. REFUND AND CANCELLATION POLICY

3.1. Digital Downloads: Due to the easily downloadable and reproducible nature of our self-guided training programs, all sales of digital products are strictly final and non-refundable. 3.2. 1:1 Online Coaching: We require a minimum of 24 hours' notice for any cancellations or requests to reschedule 1:1 coaching sessions. Sessions canceled with less than 24 hours' notice will be forfeited without a refund. 3.3. Custom Programs: Because of the personalized labor and time involved in creating tailored routines, custom programs are non-refundable once the consultation or delivery of the program has begun.

4. INTELLECTUAL PROPERTY

All content, routines, training materials, videos, text, and graphics provided by Kinetoflex LLC are our exclusive intellectual property. When you purchase a product or service, you are granted a limited, non-exclusive, non-transferable license to use the materials for your personal, non-commercial use only. You may not copy, share, distribute, or resell any Kinetoflex materials.

5. AGE REQUIREMENTS

Our Services are available to students of all ages; however, if you are under the age of 18, you must have the explicit permission and valid consent of a parent or legal guardian to purchase and participate in our programs. By using this site and purchasing our Services, you represent that you are either 18 years of age or older, or that you have obtained parental consent.

6. LIMITATION OF LIABILITY

To the maximum extent permitted by law, Kinetoflex LLC, its owners, and its coaches shall not be liable for any direct, indirect, incidental, or consequential damages resulting from your use or inability to use the website, programs, or coaching services.

7. GOVERNING LAW

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, United States, without regard to its conflict of law provisions.
